1.Sales Tax Collection
Ladder-Guard does not collect sales tax on website orders as Ladder-Guard has not established sales-tax nexus in any state at this time.
2.Pricing and Orders
All prices are shown in U.S. dollars. Prices do not include shipping or handling unless stated otherwise. We reserve the right to change pricing, availability, or discontinue products at any time.
3.Returns
Products may be returned within 30 days of delivery subject to Ladder-Guard’s return and restocking policies. An RMA is required prior to return.
4.Warranty Disclaimer and Limitation of Liability
Products are provided subject to Ladder-Guard’s limited warranty. To the fullest extent permitted by law, Ladder-Guard disclaims all implied warranties and limits its liability for indirect, incidental, or consequential damages. Ladder-Guard’s total aggregate liability to you, regardless of the cause of action, shall not exceed the purchase price you paid for the specific product giving rise to the claim. Ladder-Guard makes no representation that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

“Ladder-Guard” is a registered trademark and assumed business name of West Automotive Products LLC. Unauthorized use is prohibited.

7.Governing Law and Venue
These Terms are governed by Oregon law. Venue lies exclusively in state or federal courts located in Clackamas County, Oregon.

All payments are processed by Ladder-Guard’s third-party payment processor. Ladder-Guard does not store full credit card numbers. In the event of a payment dispute or chargeback, Ladder-Guard reserves the right to suspend or terminate your access to the Website and to seek recovery of amounts owed.
11.Shipping; Risk of Loss
Ladder-Guard ships products to the address you provide at checkout. Shipping estimates are not guaranteed delivery dates. Risk of loss and title for products pass to you upon delivery to the carrier. Ladder-Guard is not responsible for delays caused by the carrier, customs, or events outside its control.
12.Indemnification
You agree to indemnify, defend, and hold harmless West Automotive Products LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with: (a) your use of or inability to use the Website; (b) your violation of these Terms; or (c) your violation of any third-party rights.
